The Music Modernization Act (2018) is the most serious attack made against the copyrights of artists everywhere. With it, more than one thousand lawsuits against streaming corporations were swept aside. This act demands every released musical recording to be permitted for sale through streaming corporations—or any other corporation—without ever making a deal with the artists or their representatives. How is this possible at all? The law gives “price setting” for music’s recordings to a circle of three judges that are somehow supposed to work out of the United States Copyright Office. This has never been done before the MMA. It doesn’t get worse than having the government set prices for music and gigantic corporations having their way with music recordings. This arrangement is only found in music—and only because of billions of dollars in revenue generated by music sales. It’s time to cancel the MMA fully. By doing that, we can restore full copyright protections for artists in music and ensure everyone is fairly paid across the music industry.
